{"id":32524,"date":"2021-12-23T18:12:37","date_gmt":"2021-12-23T16:12:37","guid":{"rendered":"https:\/\/www.cins.rs\/?p=32524"},"modified":"2022-03-31T12:21:35","modified_gmt":"2022-03-31T10:21:35","slug":"expropriation-near-bor-land-deforested-without-permission-zijin-builds-mine-there","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/expropriation-near-bor-land-deforested-without-permission-zijin-builds-mine-there\/","title":{"rendered":"Expropriation near Bor: Land Deforested Without Permission, Zijin Builds Mine There"},"content":{"rendered":"<p>It was a snowy day in March 2019 when <strong>Pera Stanimirovi\u0107 <\/strong>went on a tour of his forest in the village of Krivelj, near Bor. Instead of a rich secluded forest, he found loggers and trees that had been cut down. The workers of private company <em>Forest 014<\/em> were unable to tell him by whose order they were logging, but Stanimirovi\u0107 guessed who it was \u2013 Chinese company <em>Serbia Zijin Copper.<\/em><\/p><p>In this area the company, which acquired the RTB Bor mining and smelting complex in 2018, was to invest in the opening of the Cerovo 2 mine, which is today also known as Novo Cerovo.<\/p><p>Stanimirovi\u0107 himself had spent a number of years of service in the mines of the mining complex near Bor, and then lived to see one such mine open on his property.<\/p><p>The <em>Center for Investigative Journalism of Serbia<\/em>\u00a0(CINS) reveals that by cutting down Stanimirovi\u0107\u2019s forest <em>Zijin <\/em>initiated the construction of the Cerovo 2 surface mine even before it had been granted a license to do so. The <em>Ministry of Finance <\/em>allowed <em>Zijin <\/em>to enter Stanimirovi\u0107\u2019s property due to \u201cthe urgency of the works\u201d only in April 2019 \u2013 a month after the deforestation.<\/p><figure id=\"attachment_32525\" aria-describedby=\"caption-attachment-32525\" style=\"width: 576px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-32525\" src=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-576x432.jpg\" alt=\"\" width=\"576\" height=\"432\" srcset=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-576x432.jpg 576w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-966x725.jpg 966w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-768x576.jpg 768w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-1536x1152.jpg 1536w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER-150x113.jpg 150w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/WORKS-AT-NOVO-CEROVO-MINE-PHOTO-BETA-SERBIA-ZIJIN-COPPER.jpg 1600w\" sizes=\"auto, (max-width: 576px) 100vw, 576px\" \/><figcaption id=\"caption-attachment-32525\" class=\"wp-caption-text\">WORKS AT NOVO CEROVO MINE; PHOTO: BETA\/ SERBIA ZIJIN COPPER<\/figcaption><\/figure><p><em>Zijin <\/em>representatives confirmed to CINS that <em>Forest 014 <\/em>had bought up and cut down trees in the territory of Cerovo 2.<\/p><p>\u201cThe company\u2019s decision on selling the forest, to a contractor who would cut down and extract the trees on their own, besides being financially justified has also made work significantly easier, at least where preparatory activities for the opening of Cerovo 2 are concerned.\u201d<\/p><p><em>Zijin <\/em>was obliged to show the <em>Forest 014 <\/em>workers the boundaries of the cadastral plots where they were allowed to cut down trees. The Chinese company representatives claim that in Stanimirovi\u0107\u2019s case it was a mistake.<\/p><p>\u201cPera Stanimirovi\u0107\u2019s cadastral plots were not the subject of the contract, but the buyer mistakenly also cut down the trees located on his plot. According to the buyer, they had done the job in snow, i.e. in conditions that did not allow them to clearly see the boundaries by which they could cut.\u201d<\/p><p>The owner of <em>Forest 014<\/em>, <strong>Simo \u0110akovi\u0107<\/strong>, in a first conversation with the CINS journalist over the telephone did not say there had been a mistake. On the contrary, he said that in this particular case his company had been the contractor, i.e. that it had logged for another company \u2013 as per their instructions:<\/p><p>\u201cWe got the route we were supposed to work on and that is what we worked on.\u201d<\/p><p>After we received a reply from <em>Zijin<\/em>, \u0110akovi\u0107 called the CINS journalist, claiming that he had not understood what case was in question, and then paraphrased the answer the company had sent us. He confirmed that his company and <em>Zijin <\/em>were cooperating to this day and that his company was deforesting land in the Bor area.<\/p><p>\u201cIt\u2019s not a mistake, it was an intention to cut down the forest. When you make a mistake, you can cross about 10 meters of the boundary, but crossing 100 meters into [someone\u2019s] property \u2013 that\u2019s no mistake. So, they\u2019re making excuses,\u201d said Pera Stanimirovi\u0107.<\/p><p>Stanimirovi\u0107 called the police on the spot to put together a report, which the police later delivered to the <em>Basic Public Prosecutor\u2019s Office in Bor. <\/em>However, we did not learn from the prosecutor\u2019s office what exactly they are doing in this case because the assigned prosecutor is on sick leave.<\/p><h2><strong>Expropriation and Zijin<\/strong><\/h2><p>When he addressed <em>Zijin <\/em>on account of the logging, Stanimirovi\u0107 was in for another unpleasant surprise. He said that at a meeting with company representatives he had found out that 5.5 hectares of forest (the size of about eight soccer stadiums) and fields were no longer his, but the property of the Chinese company. Stanimirovi\u0107\u2019s property had been seized without his knowing about it.<\/p><p>The <em>Real Estate Cadaster Service <\/em>in Bor confirmed to Stanimirovi\u0107 that the land had a new owner. The plots had been registered as property of the mining complex back since November 2018, just before the sale of RTB Bor to the Chinese investor.<\/p><p>The cadaster had sent an official decision to the address in the village where Stanimirovi\u0107 is not registered and where he does not live. The decision was then posted on a bulletin board, whereby according to regulations the document was formally delivered. By the time he realized what was going on, the deadline for an appeal had long passed.<\/p><p>\u201cI have been in Bor for 15 years and they sent me a summons to [the address] in Krivelj. (\u2026) It\u2019s a disaster. So, they take your property, you have no right to appeal, they did that on purpose so I wouldn\u2019t appeal.\u201d<\/p><p>He pressed criminal charges against the <em>Real Estate Cadaster Service <\/em>for not having attempted to deliver the decision on change of ownership at his actual place of residence.<\/p><p>To date, he has not managed to get compensation for the seized land because he is engaged in a court proceeding with <em>Zijin<\/em>.<\/p><p>\u201cYou lose your sanity and peace of mind, you take sedatives when someone usurps 5.5 hectares of your property without a penny [as compensation],\u201d Stanimirovi\u0107 complained to the CINS journalist.<\/p><figure id=\"attachment_32529\" aria-describedby=\"caption-attachment-32529\" style=\"width: 576px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-32529\" src=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/ZIJIN-ADMINISTRATIVE-BUILDING-IN-BOR-PHOTO-CINS-576x354.jpg\" alt=\"\" width=\"576\" height=\"354\" srcset=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/ZIJIN-ADMINISTRATIVE-BUILDING-IN-BOR-PHOTO-CINS-576x354.jpg 576w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/ZIJIN-ADMINISTRATIVE-BUILDING-IN-BOR-PHOTO-CINS-768x471.jpg 768w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/ZIJIN-ADMINISTRATIVE-BUILDING-IN-BOR-PHOTO-CINS-150x92.jpg 150w, https:\/\/www.cins.rs\/wp-content\/uploads\/2022\/01\/ZIJIN-ADMINISTRATIVE-BUILDING-IN-BOR-PHOTO-CINS.jpg 966w\" sizes=\"auto, (max-width: 576px) 100vw, 576px\" \/><figcaption id=\"caption-attachment-32529\" class=\"wp-caption-text\">ZIJIN ADMINISTRATIVE BUILDING IN BOR; PHOTO: CINS<\/figcaption><\/figure><p>Even though in court practice so far the price set by the <em>Tax Administration <\/em>on behalf of the authorities is taken as relevant, <em>Zijin <\/em>refutes it and requests that the value of land be determined by expert witnesses. The <em>Basic Court in Bor <\/em>rejected the company\u2019s request and ruled in Stanimirovi\u0107\u2019s favor, and ordered the company to pay more than 28.7 million dinars for the land and 5.8 million for the trees and plants.<\/p><p>However, after an appeal filed by <em>Zijin<\/em>, the <em>Higher Court in Zaje\u010dar <\/em>annulled the part of the decision referring to the price of the land, stating that the real value was unknown without evaluation by expert witnesses. In October 2021, the court sent the case back to the court in Bor for a retrial.<\/p><p><a href=\"https:\/\/www.cins.rs\/eksproprijacija-za-cukaru-peki-kako-zidjin-pokusava-da-plati-manje-za-zemlju\/\">CINS wrote earlier<\/a>\u00a0that sending a case back for a retrial is among the biggest problems where expropriation is concerned, because it stalls trials and consequently the payment of compensation for land.<\/p><h2><strong>Krivelj case in court<\/strong><\/h2><p>Expropriation for Cerovo 2 was a topic even before the arrival of the Chinese investor. The <em>Cadaster <\/em>in Bor transferred ownership of Stanimirovi\u0107\u2019s land because the Bor municipal administration in 2016 decided to allow RTB Bor to forcefully seize the forest and the field.\u00a0<a href=\"http:\/\/bor.rs\/wp-content\/uploads\/2018\/02\/PPO-Bor-Knjiga-2_januar-2014.pdf\">According to the municipal spatial plan adopted in 2014<\/a>, the Cerovo 2 surface mine was planned on Stanimirovi\u0107\u2019s land.<\/p><p>RTB Bor, however, should not have entered the property before making an agreement with Stanimirovi\u0107 on compensating him for the land covered by the expropriation. <em>Zijin <\/em>should not have done that either, before the <em>Ministry of Finance <\/em>green-lighted it. The company had requested entry because of works on the transmission network in this part of Serbia, which the <em>Ministry <\/em>allowed in April 2019.<\/p><p>Since no compensation has been agreed on yet, Stanimirovi\u0107 claims that the <em>Ministry\u2019s <\/em>decision is illegal, while a proceeding is under way on his appeal before the <em>Administrative Court.<\/em><\/p><p>\u201cIn this way, the user is directly aided to bypass the expropriation procedure,\u201d reads the claim signed by <strong>Predrag Savi\u0107<\/strong>, a lawyer with years of experience in expropriation cases.<\/p><div class=\"rmbox\"><div class=\"rmboxteaser\"><p style='box-sizing: border-box; margin: 0px 0px 1rem; font-family: Montserrat; font-size: 16.67px; letter-spacing: 1px; padding: 0px; border: 0px; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-stretch: inherit; line-height: inherit; vertical-align: baseline; background-color: #efefef;'>Thank you for reposting CINS articles!
