{"id":31580,"date":"2021-09-29T12:49:47","date_gmt":"2021-09-29T10:49:47","guid":{"rendered":"https:\/\/www.cins.rs\/?p=31580"},"modified":"2021-10-20T16:20:16","modified_gmt":"2021-10-20T14:20:16","slug":"life-after-employment-in-state-sector-where-do-public-officials-go","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/life-after-employment-in-state-sector-where-do-public-officials-go\/","title":{"rendered":"Life After Employment in State Sector: Where Do Public Officials Go?"},"content":{"rendered":"<p><strong>Filip Bankovi\u0107 <\/strong>will be the chief technology officer and executive director for international markets at <em>Roaming Networks<\/em>, the company announced on its accounts on social networks in January 2021.<\/p><p>This company is publicly known primarily for <strong>Nenad Kova\u010d<\/strong>, its majority owner. Kova\u010d, a.k.a. Ne\u0161a Roming, is a businessman whose operations have ranged from the company managing Belgrade\u2019s public transportation ticketing system\u00a0<a href=\"https:\/\/www.cins.rs\/do-busplusa-kroz-rupe-u-sistemu\/\">Bus Plus<\/a>,\u00a0<a href=\"https:\/\/www.cins.rs\/firma-nenada-kovaca-izbacena-iz-posla-u-danskoj\/\">operations in Denmark<\/a>, to\u00a0<a href=\"https:\/\/www.cins.rs\/male-hidroelektrane-drzava-i-firme-povezane-sa-vucicevim-kumom-najvise-profitiraju\/\">small hydropower plants<\/a>\u00a0where one of his partners is\u00a0<strong>Nikola Petrovi\u0107<\/strong>, Serbian President\u00a0<strong>Aleksandar Vu\u010di\u0107<\/strong><strong>\u2019s best man<\/strong>.<\/p><p>In an\u00a0<a href=\"https:\/\/pcpress.rs\/intervju-5g-motor-razvoja-i-pokretac-industrije\/\">interview with the PC press magazine<\/a>, Bankovi\u0107 recently, as a representative of <em>Roaming Networks<\/em>, talked about the company\u2019s projects and the development of fifth-generation mobile networks, so-called 5G networks. This is a subject he is well versed in, since he <a href=\"https:\/\/pcpress.rs\/5g-intervju-filip-bankovic-telekom-srbija\/\">talked about it in an interview with the same magazine<\/a>\u00a0two years earlier \u2013 but back then as a member of the Executive Board, i.e. as an executive director of national telecom operator <em>Telekom Srbija.<\/em><\/p><p>Research conducted by the\u00a0<em>Center for Investigative Journalism of Serbia<\/em>\u00a0(CINS) reveals that Bankovi\u0107 was not actually allowed to go from <em>Telekom <\/em>to <em>Roaming <\/em>because the <em>Agency for Prevention of Corruption <\/em>refused to give him the required consent in December 2020.<\/p><p><a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon-o-sprecavanju-korupcije.html\">The Law on Prevention of Corruption<\/a>\u00a0bans officials from getting a job at or starting business cooperation with companies or organizations related to the office an official had held until then \u2013 so-called \u201cpantouflage\u201d \u2013 over the course of two years after the cessation of their public office, without the <em>Agency\u2019s <\/em>consent. The goal is to avoid a conflict of interest, i.e. to prevent an outgoing official from abusing their political influence, contacts and information for gains at their new job.<\/p><p>According to the documents CINS received from the <em>Agency, <\/em>as one of the <em>Telekom <\/em>executive directors Bankovi\u0107 was involved in decision-making on business cooperation between the state-owned company and <em>Roaming. <\/em><\/p><p>Bankovi\u0107 appealed the decision to the <em>Agency <\/em>Council (formerly Committee) on January 19, and the Council decided on the appeal no earlier than May, at which point he had already been at his new firm for five months.<\/p><p>The Council annulled the original decision and halted the procedure. The reason for that is the authentic interpretation of the Law on Prevention of Corruption which the <em>National Assembly <\/em>adopted in February this year, but which is applied retroactively, as of September 1, 2020. According to the interpretation, some officials, depending on their post, are not officials after all.<\/p><p><strong>Nemanja Nenadi\u0107 <\/strong>of <em>Transparency Serbia <\/em>believes that Bankovi\u0107 had been committing a violation until the moment his appeal was decided on. He adds that this resolution of Bankovi\u0107\u2019s case is a consequence of the harmful interpretation by the <em>National Assembly. <\/em>However, even if he had been handed down a fine and paid it, the money would have been paid back to him from the state budget.<\/p><p>\u201cIf, for example, an official is exempted by the authentic interpretation, and (previously) provided false data, did not report their property or lied about something that is a criminal offense, even if they did so deliberately, they would not be held accountable for that,\u201d explains Nenadi\u0107.<\/p><p>Under the Law, because of the violation Bankovi\u0107 could have been handed down a fine of between 50,000 and 150,000 dinars.<\/p><p>He did not answer the questions we had sent him via e-mail. In the appeal, Bankovi\u0107 claimed, among other things, that the work he would be doing at <em>Roaming <\/em>was not connected with <em>Telekom\u2019s <\/em>activities, nor with the business relationship between the two companies during the time he occupied the official position.<\/p><p>\u201cI would like to point out that as a member of the Executive Board of <em>Telekom Srbija <\/em>a.d. I did not decide on the rights and obligations of <em>Roaming Networks <\/em>doo because the decisions that were made would have been made even without my vote, by the votes of the other members of the Executive Board,\u201d Bankovi\u0107 wrote in his appeal.<\/p><p><strong>Officials mostly got consent<\/strong><\/p><p>Filip Bankovi\u0107 is not the only official to have requested the consent of the <em>Agency for Prevention of Corruption <\/em>to move to a different job position after working in the public sector. According to this institution\u2019s data, from January 2018 to June 2021 public officials addressed it 98 times. In the majority of cases, 51 to be specific, the <em>Agency <\/em>issued consent, whereas in 20 cases it refused to do so in the first-instance procedure. It did not make any decisions in 27 cases because they were not about a public position, and more than two years had passed since the cessation of a term of office or because its consent was not necessary.<\/p><p>Requests for consent were most often submitted by assistant ministers and ministers, 23 of them, while 21 requests were filed by heads of public administrations, agencies and local public companies, and their assistants.<\/p><p>Among these officials is former minister of trade, tourism and telecommunications\u00a0<strong>Rasim Ljaji\u0107<\/strong><strong>, who early this year asked to be allowed to \u201cperform occasional consulting services and cooperation with Arab countries\u201d for Turkish company<\/strong>\u00a0<em>Bayegan Group<\/em>.<\/p><p>He was given consent after the incumbent tourism minister,\u00a0<strong>Tatjana Mati\u0107<\/strong><strong>, said in a memo to the <em>Agency <\/em>that there had been no form of cooperation with the Turkish representative during Ljaji\u0107\u2019s term of office.<\/strong><\/p><p>Nonetheless, Ljaji\u0107 told CINS that the job had not happened because he had waited for the consent for a long time, resulting in <em>Bayegan <\/em>changing its priorities.<\/p><p>\u201cI\u2019ve known [these] people for a long time, they haven\u2019t done anything here, they work only with Arab countries. (\u2026) We have common friends, they are originally from here (from Novi Pazar), I know these people completely privately,\u201d says Ljaji\u0107.<\/p><p><em>Bayegan Group<\/em>\u00a0and basketball player\u00a0<strong>Mirsad Jahovi\u0107<\/strong>\u00a0in April 2020 donated a portable X-ray machine to the COVID-19 hospital in Novi Pazar, a city which was a coronavirus infection hotspot at that time. The value of the machine is estimated at upwards of 35,000 dollars, broadcaster <em>RTV Novi Pazar<\/em>\u00a0<a href=\"https:\/\/rtvnp.rs\/2020\/04\/17\/kuplatforma-prijatelji-sandzaka-uputili-dragocenu-pomoc-covid-bolnici\/76011\">reports<\/a>.<\/p><p>The institution from which the biggest number of officials departed is the <em>Ministry of Finance, <\/em>ten of them, and they requested consent for the purpose of cooperation with or employment at international institutions and consortiums, such as the <em>Auditing and Consulting Association KPMG <\/em>or the <em>United Nations Development Program<\/em>\u00a0(UNDP), or for other positions in the public sector.<\/p><p><strong>Nikola Petrovi\u0107\u2019s accidental oversight<\/strong><\/p><p>When checking a potential conflict of interest, the <em>Agency for Prevention of Corruption <\/em>relies the most on officials\u2019 claims, Internet search and statements from institutions.<\/p><p>Nenadi\u0107 says that it is logical for the <em>Agency <\/em>to first address the body where a particular official was previously employed, but adds that there should be a mechanism in the event that the information is incomplete. He underscores that there is no option for someone \u201cfrom the outside\u201d to point out something controversial before the <em>Agency <\/em>gives its consent, because the procedure is not public.<\/p><p><a href=\"https:\/\/javno.rs\/baze\/pantoflaza\/index.php\">According to BIRN<\/a>, Nikola Petrovi\u0107, President Aleksandar Vu\u010di\u0107\u2019s best man and former director of national transmission system operator <em>Elektromre\u017ea Srbije <\/em>(EMS), after the end of his term in office became the director and co-owner of a company called\u00a0<em>Mini Hydro Investments<\/em>. In 2017 and 2018, he indirectly obtained shares in companies dealing with mini hydropower plants \u2013\u00a0<em>Eco Energo Group<\/em>,\u00a0<em>MHE Jabukovik<\/em>\u00a0and\u00a0<em>\u017dupanj<\/em>.<\/p><p>Even though the <em>Agency <\/em>had given him its consent for employment at <em>Eco Energo Group<\/em>, Petrovi\u0107 requested consent for\u00a0<em>Mini Hydro Investments<\/em>\u00a0and\u00a0<em>MHE Jabukovik<\/em>, as well as for another company \u2013\u00a0<em>Eko Vlasina <\/em>\u2013 only after BIRN released the article. He said that it was \u201can accidental oversight.\u201d<\/p><p>Seeing as it had not been submitted by the envisaged deadline, the <em>Agency <\/em>rejected the request, which the <em>Agency <\/em>Council also confirmed after Petrovi\u0107\u2019s appeal.<\/p><p>This institution did not answer the question about whether it had launched a procedure against Petrovi\u0107 for that, while representatives of the <em>Misdemeanor Court in Belgrade <\/em>say that the <em>Agency <\/em>has not launched misdemeanor proceedings against him since 2017.<\/p><p>Nenadi\u0107 highlights as another problem the fact that there are no clear criteria because of which an official would not be able to find a new job or start business cooperation. In his words, that is largely subject to the interpretation capabilities of the <em>Agency <\/em>itself.<\/p><p>He mentions, as an example, the situation in which <em>Transparency <\/em>attempted to hire the former <em>Commissioner for Information of Public Importance, <\/em><strong>Rodoljub \u0160abi\u0107<\/strong>.<\/p><p>At the time, \u0160abi\u0107 sought the <em>Agency\u2019s <\/em>consent to work as a legal expert on articulating proposals for legal solutions, including the area of curbing corruption, seizing illegal property, conflict of interest, and suppressing money laundering.<\/p><p>The <em>Agency <\/em>rejected his request because the two organizations had participated in a joint project in the past, as well as because the office of the <em>Commissioner <\/em>had decided on appeals submitted by <em>Transparency.<\/em><\/p><p>In a statement to CINS, Rodoljub \u0160abi\u0107 says that this legal provision is bad and does not serve the purpose of curbing corruption. He thinks it can be powerful as an instrument of punishing or retaliating against the officials who worked in line with the law during their term in office, and who were not ready to take appropriate orders or make concessions.<\/p><p>\u201cThe <em>Commissioner <\/em>always resolves [issues] in the public interest, therefore, regardless of whether you from CINS, <em>Transparency <\/em>or some ordinary Joe submitted an appeal, I do no debate whether it is your subjective right to see it (particular information), but rather whether it is the public\u2019s right to see it.
