{"id":28564,"date":"2020-11-23T11:06:56","date_gmt":"2020-11-23T09:06:56","guid":{"rendered":"https:\/\/www.cins.rs\/?p=28564"},"modified":"2021-07-22T15:10:49","modified_gmt":"2021-07-22T13:10:49","slug":"private-firm-pays-for-pro-boycott-tv-spots-denies-any-connection-with-opposition","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/private-firm-pays-for-pro-boycott-tv-spots-denies-any-connection-with-opposition\/","title":{"rendered":"Private Firm Pays for Pro-Boycott TV Spots, Denies Any Connection with Opposition"},"content":{"rendered":"<p>\u201cThe only way not to vote for Vu\u010di\u0107 is not to vote at all.\u201d That was the message of the pro-boycott TV ads that could be seen on <em>N1 <\/em>and <em>Nova S <\/em>televisions ahead of the general election in June.<\/p><p>Soon after the <em>Regulatory Authority for Electronic Media <\/em>(REM) banned them from airing, as they was contrary to the law, spots with a different slogan, \u201cThe only way not to vote for the regime is not to vote at all\u201d appeared on the aforementioned cable channels. REM again ordered that the televisions stop airing these ads, as it was unknown who the advertiser was and whether they had a right to political advertising.<\/p><p>According to the regulatory body\u2019s final report on the election, on June 16 it asked the owners of <em>N1<\/em> and <em>Nova S<\/em> for the advertising declarations for these spots. They were not delivered but in spite of that REM categorized them in its report as ads of the Alliance for Serbia (SZS), stating that it had counted 222 instances of airing in total on <em>N1<\/em> and 180 in total on <em>Nova S<\/em>.<\/p><p>However, according to experts this campaign will remain beyond the reach of the <em>Anti-Corruption Agency<\/em> because it was not the <em>Alliance for Serbia<\/em> or any of the pro-boycott political parties who paid the televisions to air the ads, but rather a company called <em>JSP Audio and Video Production<\/em>, the<em> Center for Investigative Journalism of Serbia<\/em> (CINS) has learned. This production company was founded in April 2018 and its owner and director is journalist <strong>Jovana Poli\u0107<\/strong>.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">What is JSP Production?<\/h2><div class=\"antrefilecont\"><p>                                       <em>JSP Production<\/em> attracted public attention in February 2020 when its two-part documentary The Ruler, on the biography of Serbian President <strong>Aleksandar Vu\u010di\u0107<\/strong>, directed by <strong>Jovana Poli\u0107<\/strong>, edited by <strong>Sanja Lon\u010dar<\/strong> and created by journalist <strong>Slavi\u0161a Leki\u0107<\/strong>, aired on <em>N1<\/em>. Vu\u010di\u0107 commented on the film at the time as \u201cfour hours of unadulterated hate,\u201d which was why Leki\u0107 announced he would file a lawsuit against the president. <em>JSP<\/em> said that in addition to Vu\u010di\u0107 it would also sue <em>Informer<\/em> Editor-in-Chief <strong>Dragan J. Vu\u010di\u0107evi\u0107<\/strong> because the tabloid had published the production company\u2019s business data and because it had said that the film had been financed by the European Union and <strong>Dragan \u0160olak<\/strong>, one of the heads of <em>United Group<\/em>, which <em>N1<\/em> and <em>Nova S<\/em> are a part of.<\/p><\/div><\/div><\/div><p>Poli\u0107 told CINS that the plan was for these ads to be aired for six days, 672 times in total. In her words, the production company made the spots and paid for their airing:<\/p><p>\u201cBecause we took part in the boycott campaign. It was not for any party.\u201d<\/p><p>These ads, besides the messages they send, partially visually resemble the official boycott campaign of the<em> Alliance for Serbia <\/em>(SZS). At the end of the spots the election date is crossed out with a red X, followed by the word \u201cBoycott\u201d written in Cyrillic script, with a red full stop, similar to the Alliance campaign.<\/p><figure id=\"attachment_28565\" aria-describedby=\"caption-attachment-28565\" style=\"width: 1920px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-28565 size-full\" src=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1.png\" alt=\"\" width=\"1920\" height=\"1080\" srcset=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1.png 1920w, https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1-576x324.png 576w, https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1-966x543.png 966w, https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1-768x432.png 768w, https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/11\/bojkoti-1-1536x864.png 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><figcaption id=\"caption-attachment-28565\" class=\"wp-caption-text\">Boycott sign of the Alliance for Serbia (left) and the boycott sign at the end of the JSP ProductionTV spot (right); photo: Screenshot\/Facebook Alliance for Serbia\/YouTube Party of Freedom and Justice<\/figcaption><\/figure><p>Nevertheless, given that the production company claims that no political party paid for the ads but rather that it did so itself, the whole case remains beyond the reach of the <em>Anti-Corruption Agency<\/em>, <strong>Vladimir Tupanjac<\/strong>, a lawyer and former employee at the <em>Agency<\/em>\u2019s Sector for Oversight of Financing Political Activities, told CINS.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">\u201cThird party\u201d commissions campaign for Progressives in 2016, then cheats Happy TV<\/h2><div class=\"antrefilecont\"><p>As the portal <a href='https:\/\/www.cenzolovka.rs\/trziste\/prevara-na-tv-hepi-ostalo-neplaceno-500-000-evra-za-reklame-srpske-napredne-stranke\/' target='_blank' rel='noopener noreferrer'><em>Cenzolovka<\/em><\/a> reported earlier, at least 249 spots of the <em>Serbian Progressive Party <\/em>(SNS) aired during the 2016 election campaign on national free-to-air <em>Happy TV<\/em>, were left unpaid for at the time. <em>Happy TV<\/em> claimed that an agency called <em>MP Media<\/em> had contracted the advertising, purporting to work on behalf of the <em>Progressive party<\/em>. The Progressives, however, denied having commissioned those ads and so the cost of the campaign of roughly 62 million dinars was not paid. The <em>Third Basic Public Prosecutor\u2019s Office<\/em> checked the case on suspicion of fraud, while the <em>Anti-Corruption Agency<\/em> determined the existence of suspicion that a \u201cthird party\u201d in no way affiliated with the <em>Serbian Progressive Party<\/em> had committed a criminal offense. According to <a href='https:\/\/www.cenzolovka.rs\/trziste\/savrsena-prevara-slucaj-besplatnog-oglasavanja-sns-a-policija-ne-moze-da-resi\/' target='_blank' rel='noopener noreferrer'><em>Cenzolovka<\/em><\/a>, by mid-2017 neither the police nor the prosecutor\u2019s office had managed to discover who had commissioned these spots.<\/p><\/div><\/div><\/div><p>The <em>Agency<\/em> is authorized to initiate and lead a procedure to determine whether the Law on Financing Political Activities has been violated. However, as he puts it, it can only oversee political entities and the legal entities and natural persons who provide services to the said entities, as well as political entities\u2019 donors. If there is no legal, i.e. actual connection between the person who paid for a service and a political entity, he says, that is considered freedom of expression. The law does not recognize this, known in theory as financing by a third party:<\/p><p>\u201cA natural person or a legal entity can in a completely unrelated way, at their own expense, lead a complete campaign for a political entity and that cannot be subject to oversight in any way,\u201d Tupanjac explains.<\/p><p>He adds that the same problem occurs in the United States of America, too, where legal entities can lead entire campaigns for political entities without being subject to restrictions.<\/p><h2>Alliance for Serbia and a Donation<\/h2><p>Even though the boycott ads were taken off the TV channels soon after they debuted, they appeared on <em>YouTube, <\/em>specifically on the official channel of the <em>Party of Freedom and Justice<\/em> (SSP), a member of the <em>Alliance for Serbia<\/em> (SZS).<\/p><p>Poli\u0107 told CINS that her company permitted all who wanted to put the spots on their communication channels to do so. However, aside from the party led by <strong>Dragan \u0110ilas<\/strong>, no others contacted them for that purpose.<\/p><p>\u201cThey (<em>Party of Freedom and Justice, journalist\u2019s note<\/em>) were in a boycott campaign and we had nothing against their putting [the ads on their channel].\u201d<\/p><p>In a reply to CINS\u2019 questions, \u0110ilas denied that the spots had anything to do with his party.<\/p><p>\u201cWe put them on our <em>YouTube<\/em> after their airing on televisions was prohibited. And there are no <em>Party of Freedom or Justice<\/em> labels on them,\u201d \u0110ilas said in an SMS text message.<\/p><p>Although Dragan \u0110ilas says that nobody donated anything to his party because what is donated would then have to become the party\u2019s property, the <em>Agency <\/em>said in a reply to CINS that \u201cif a legal entity or a natural person makes and pays for the airing of an advertising message (spot) on television and then gives that same advertising message to a political party free of charge, and that party posts it on its official <em>YouTube <\/em>channel, the legal entity or natural person has through that action given a gift, i.e. (non-financial) contribution to the political party.\u201d<\/p><p>Judging by a memo from the <em>Agency, <\/em>the <em>Party of Freedom and Justice <\/em>should report this contribution in the annual financial statement for 2020, which is to be submitted by mid-April 2021.<\/p><h2>Price Multiply Lower Outside of Political Bloc<\/h2><p><strong>Marija Kovljeni\u0107, <\/strong>director of <em>CAS Media<\/em>, an agency within <em>United Group <\/em>which deals with the sale of advertising space on <em>N1 <\/em>and <em>Nova S <\/em>televisions<em>, <\/em>told CINS that a total of 407 advertising messages had aired during this campaign, five more than what was detected by REM.<\/p><p>The sum paid for their airing was 1.2 million dinars, according to <em>JSP Production <\/em>owner Jovana Poli\u0107.<\/p><p>CINS compared the campaign expenses and found that price to be much lower than the one paid by some political parties that had advertised themselves on <em>N1 <\/em>ahead of the election.<\/p><p>For example, according to data provided by REM and the <em>Anti-Corruption Agency, <\/em>the <em>Serbian Progressive Party <\/em>(SNS) paid around 3.9 million dinars for 28 ads on N1, while the <em>United Democratic Serbia <\/em>(UDS) coalition paid 3.3 million for 20 spots.<\/p><p>REM calculated in its monitoring that, proportionately with the number of ads, the spots calling for an election boycott were in the top spot in terms of duration as well. The pro-boycott ads on these two televisions combined lasted just over three hours, whereas the airing of <em>Serbian Progressive Party <\/em>campaign ads on <em>N1 <\/em>totaled about 21 minutes, and the ads of <em>United Democratic Serbia <\/em>just over 18 minutes.<\/p><p>Another participant in the election advertised their political option on <em>N1<\/em> and <em>Nova S<\/em>. <strong>Aleksandar \u0160api\u0107<\/strong>\u2019s S<em>erbian Patriotic Alliance<\/em> (SPAS) paid 1.7 million dinars for 15 ads, the duration of which added up to just over eight minutes.<\/p><div class=\"fullwreg\"><div style='position: relative; width: 100%; height: 0; padding-top: 116.6667%;\r\npadding-bottom: 48px; box-shadow: 0 2px 8px 0 rgba(63,69,81,0.16); margin-top: 1.6em; margin-bottom: 0.9em; overflow: hidden;\r\nborder-radius: 8px; will-change: transform;'>\r\n<iframe style='position: absolute; width: 100%; height: 100%; top: 0; left: 0; border: none; padding: 0;margin: 0;'\r\n    src='https:&#x2F;&#x2F;www.canva.com&#x2F;design&#x2F;DAEOaKw09SA&#x2F;view?embed'>\r\n<\/iframe>\r\n<\/div><\/div><p>Even though the pro-boycott ads had a political message and were broadcast before the election, the reason for the lower price, according to Kovljeni\u0107, is the fact that they were not a part of political marketing.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">The same elements in Bo\u0161ko Obradovi\u0107\u2019s campaign<\/h2><div class=\"antrefilecont\"><p>A <a href='https:\/\/www.youtube.com\/watch?v=0sY63XfX9CY' target='_blank' rel='noopener noreferrer'>spot<\/a> was posted on June 20 on the <em>YouTube<\/em> channel of <em>Dveri<\/em>, a party which was a member of the <em>Alliance for Serbia<\/em> (SZS) until the end of summer. <em>Dveri<\/em> leader <strong>Bo\u0161ko Obradovi\u0107<\/strong> says that the opposition spot is from the boycott campaign but that he does not know who made it. Elements from the <em>JSP Production<\/em> ad appear at the very end of the spot, however Obradovi\u0107 was unable to tell us whether it was the same boycott campaign.<\/p><\/div><\/div><\/div><p>\u201e<em>CAS Media <\/em>aired the <em>JSP Production\u2019s <\/em>advertising campaign during regular commercial breaks according to REM\u2019s interpretation,\u201d reads the agency\u2019s reply to CINS.<\/p><p>We did not manage to get <em>CAS Media <\/em>to explain what interpretation by REM they were referring to, and how the airing was contracted before that interpretation was released.<\/p><p>Jovana Poli\u0107 says they did not ask for a discount and that they accepted the offer they had received from the agency.<\/p><p>She refused to send the CINS journalist a copy of the contract made with <em>CAS Media, <\/em>while representatives of that agency told us that they could not discuss contract values without the consent of the contracting parties.<\/p><p>&nbsp;<\/p><div class=\"rmbox\"><div class=\"rmboxteaser\"><p>Thank you for reposting CINS articles!
