{"id":28338,"date":"2020-10-27T16:17:34","date_gmt":"2020-10-27T14:17:34","guid":{"rendered":"https:\/\/www.cins.rs\/?p=28338"},"modified":"2021-03-24T14:28:53","modified_gmt":"2021-03-24T12:28:53","slug":"mps-do-not-report-money-for-fuel-sai-and-budget-inspector-ignore-zoran-babics-case","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/mps-do-not-report-money-for-fuel-sai-and-budget-inspector-ignore-zoran-babics-case\/","title":{"rendered":"MPs Do Not Report Money for Fuel, SAI and Budget Inspector Ignore Zoran Babic\u2019s Case"},"content":{"rendered":"<p>In early 2016, a report from the <em>Anti-Corruption Agency<\/em> was delivered to the addresses of the <em>State Audit Institution<\/em> (SAI) and the <em>Ministry of Finance\u2019s<\/em> Budget Inspectorate \u201cfor further jurisdiction and decision-making.\u201d <strong>Zoran Babi\u0107<\/strong> had not reported all of his income.<\/p><p>The <em>Serbian Progressive Party<\/em> official and acting director of the <em>Corridors of Serbia<\/em> company was a member of the <em>National Assembly<\/em> at the time, which provided him with a monthly salary, MP supplement, money for business trips, but also for fuel for his car which he drove to work.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><div class=\"antreimg\"><img decoding=\"async\" src=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/10\/Zoran-Babi\u0107-1.jpg\"  \/>\n            <figcaption class=\"wp-caption-text\"> <\/figcaption>\n            <\/div><div class=\"antrefilecont\"><p><em>Zoran Babi\u0107; photo: N1<\/em><\/p><\/div><\/div><\/div><p>If an MP\u2019s income is cut or raised by the amount of the average net annual salary (the so-called significant change), they are obliged to submit an extraordinary report on income in which they will include the fuel money. The MPs must also report this income if the fuel itself exceeds that limit.<\/p><p>When checking Babi\u0107\u2019s income reports, the <em>Agency<\/em> found that the monthly earnings he had reported did not match the actual numbers, which is why it issued a warning in April 2016. In 2014 alone, close to 874,000 dinars without taxes was taken from the budget for his arrivals by car.<\/p><p>Although the <em>Assembly\u2019s<\/em> finance department did not interpret those expenses as earnings because they were incurred during the performing of the MP job, the Tax Administration does perceive it as income and so Babi\u0107 was obliged to report it, according to the <em>Agency<\/em>.<\/p><p>However, the <em>Center for Investigative Journalism<\/em> (CINS) has learned that not a single institution has checked the <em>Agency\u2019s<\/em> allegations. The SAI and the Budget Inspectorate gave practically identical replies \u2013 the annual working report did not envisage checking Babi\u0107\u2019s income, and due to limited capacity the institutions did not act on a report beyond their regular plan. The check was not included in next year\u2019s work plan either.<\/p><p><strong>Bo\u017eo Dra\u0161kovi\u0107<\/strong>, a professor at the <em>Faculty of Applied Ecology Futura<\/em> and a former member of the <em>Agency<\/em> Board, believes that in this way the institutions wanted to avoid conducting the check:<\/p><p>\u201cThat is a convenient excuse when you want to not do something, you say that you did not have the time, that it was not planned.\u201d<\/p><p>In a conversation with the CINS journalist, Zoran Babi\u0107 said that he had not been an MP for years and \u201ccannot go back to that time.\u201d<\/p><p>\u201cEverything that was done was done in accordance with the law,\u201d Babi\u0107 claims.<\/p><p>Nevertheless, Babi\u0107 is not the only one who has not reported this income.<\/p><p>According to CINS\u2019 database called How Much Does an MP Cost, 289.6 million dinars was set aside for the fuel expenses of MPs who came to sessions in their own cars between 2016 and 2020.<\/p><p>Among them are the expenses of at least 32 incumbent MPs who did not report fuel reimbursement during the previous term of office, and traveled from other cities and towns to Belgrade for parliamentary sessions, shows the CINS analysis. That income cannot be found in any of their reports available on the <em>Agency<\/em> website.<\/p><div class=\"fullws\"><iframe src='https:\/\/flo.uri.sh\/visualisation\/4161556\/embed' title='Interactive or visual content' frameborder='0' scrolling='no' style='width:100%;height:400px;'><\/iframe><\/div><p>In its reply to CINS, the <em>Agency<\/em> says that it cannot single out the MPs against whom it had issued measures or conducted procedures for failure to report these payments, because it \u201cdoes not keep records of procedures initiated according to this type of criterion.\u201d The <em>Agency<\/em> also did not say whether any of the 32 MPs had reported fuel income and that had not ended up in the official register on the <em>Agency<\/em> website.<\/p><div class=\"fullws\"><iframe src='https:\/\/flo.uri.sh\/visualisation\/4161787\/embed' title='Interactive or visual content' frameborder='0' scrolling='no' style='width:100%;height:500px;'><\/iframe><\/div><h2>MPs\u2019 Intent or Ignorance<\/h2><p>Among the 32 MPs in question, the biggest number, i.e. 20, represent the ruling <em>Serbian Progressive Party<\/em> \u2013 they did not report a total of 53.1 million dinars for fuel used between 2016 and 2020.<\/p><p>One of them is <strong>\u017darko Bogatinovi\u0107<\/strong> \u2013 an MP from Leskovac who received the biggest amount of money, i.e. whose fuel and depreciation <a href=\"https:\/\/www.cins.rs\/baze-podataka\/koliko-kosta-poslanik\/profil\/?ref=90014\" target=\"_blank\" rel=\"noopener noreferrer\">cost 3.7 million dinars<\/a>, but that is not visible in the publicly available income register. Fuel expenses had for years exceeded the average salary in the case of <strong>Darko Laketi\u0107<\/strong> and <strong>Slavi\u0161a Bulatovi\u0107<\/strong> as well.<\/p><p>Bogatinovi\u0107 briefly told CINS that he believed that it was not income, but rather gasoline and road toll expenses covered by the <em>Assembly<\/em>, to which he pointed the CINS journalist for any further questions.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">MPs paid millions for fuel based on \u201cscout\u2019s honor\u201d<\/h2><div class=\"antrefilecont\"><p>As CINS reported earlier, the MPs who come to parliamentary sessions in their own car do not justify the money given for fuel by receipts, but only by signing statements. Even the MPs who have apartments in Belgrade, like <strong>Darko Laketi\u0107<\/strong>, use these benefits, which CINS\u2019 interlocutors see as malfeasance.  <\/p>\r\n<p>Read more about it <a href='\/en\/mps-get-millions-for-fuel-solely-based-on-their-own-statements\/' target='_blank' rel='noopener noreferrer'>HERE<\/a>.<\/p><\/div><\/div><\/div><p>Laketi\u0107, in his own words, after the CINS journalist\u2019s first telephone call contacted the <em>Agency<\/em>, where he claims he was told he did not need to report these payments.<\/p><p>\u201cI called to see if I had made a mistake and was literally told, \u2018No, you did not make [a mistake], member of parliament\u2019.\u201d<\/p><p>However in its reply to CINS, the <em>Agency<\/em> confirmed that if they exceeded the limit, officials did have to report this income:<\/p><p>\u201cThe reimbursement a public official receives for using their own vehicle for official purposes does not represent separate income in the sense of the Law on Prevention of Corruption, which the public official is obliged to report in the Property and Income Report, if it annually does not exceed the amount of significant change, which depends on each particular case.\u201d<\/p><div class=\"rmbox\"><h2 class=\"rmboxtitle\">Opposition MPs also \u201ckept quiet\u201d about fuel<\/h2><div class=\"rmboxteaser\"><p>Although the parties that were the parliamentary opposition are not a part of the new parliament, their representatives have in the past come to sessions in their own cars and received money for that. However, like their colleagues from the ruling coalition, they did not report that to the <em>Anti-Corruption Agency<\/em>.<\/p><\/div><div id=\"rmtease5249291\" class=\"rmboxtext hidden\"><p>As a member of the <em>People\u2019s Party<\/em>, <strong>Miroslav Aleksi\u0107<\/strong> traveled from Trstenik to Belgrade in 2018 and received 614,000 dinars for fuel expenses \u2013 whereby he exceeded the 595,800 dinars that was the average annual salary that year. <\/p>\r\n<p><em>Party of Modern Serbia<\/em> member <strong>Vladimir \u0110uri\u0107<\/strong> came to the <em>National Assembly<\/em> from Novi Sad, for which he received just under 200,000 dinars in 2016. In early 2017, \u0110uri\u0107 reported as a significant change to the <em>Agency<\/em> that he was receiving a salary from the Assembly, but not the payments for fuel.<\/p>\r\n<p>\u0110uri\u0107 did not report the fuel reimbursement because, like the <em>Assembly<\/em>, he does not consider it income:<\/p>\r\n<p>\u201cThe matter is technical by nature, I did not enter it simply because I did not feel the need and did not find a place in the form where I would enter it anyway, since I was entering the salary I was receiving, you see. And this is for me the logic that \u2018reimbursement\u2019 is not income. Two members of the <em>Socialist Party of Serbia<\/em> and two members of the <em>Social Democratic Party of Serbia<\/em> did the same.<\/p><p>Dra\u0161kovi\u0107 says that it is often not a matter of an official\u2019s intent to cover up income, \u201cbut rather ignorance, superficiality, thinking \u2018I am too powerful\u2019.\u201d Nonetheless, that does not justify the violation of regulations and, if they knew they would be penalized, officials would report that income, too, Dra\u0161kovi\u0107 believes.<\/p><div class=\"fullws\"><iframe src='https:\/\/e.infogram.com\/ee358548-8893-4a73-8e8d-a1e447763f25?src=embed' title='Copy: Poslanici 4 godine iznad proseka' width='920' height='508' scrolling='no' frameborder='0' style='border:none;' allowfullscreen='allowfullscreen'><\/iframe><\/div><div class=\"rmbox\"><div class=\"rmboxteaser\"><p>Thank you for reposting CINS articles! Although the Anti-Corruption Agency issued a warning over this to Zoran Babi\u0107, the institutions it had asked to look into the matter further have not done so to date.
