{"id":27159,"date":"2020-02-24T15:35:22","date_gmt":"2020-02-24T13:35:22","guid":{"rendered":"https:\/\/www.cins.rs\/?p=27159"},"modified":"2020-10-28T17:23:02","modified_gmt":"2020-10-28T15:23:02","slug":"chinese-investor-in-court-for-pollution-in-bor","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/chinese-investor-in-court-for-pollution-in-bor\/","title":{"rendered":"Chinese investor in Court for Pollution in Bor"},"content":{"rendered":"<p>At the end of a workweek, employees of <em>Zijin, <\/em>formerly RTB Bor, were met with an unpleasant surprise at the doors of the administrative building \u2013 their fellow citizens were whistling and booing them, shouting, \u201cBoo! You\u2019ve betrayed the town!\u201d Backed by the inhabitants or nearby small towns and villages, as well as by political activists, on November 15, 2019 a number of Bor citizens protested months\u2019 worth of pollution coming from the mining complex. With the message, \u201cOur health or your profit,\u201d and with masks on their faces, they asked the Chinese investor to reduce the volume of production and thereby the air pollution that was suffocating them.<\/p><p>\u201cSulfur dioxide directly damages the airways,\u201d Dr. <strong>Dragica Rado\u0161evi\u0107 <\/strong>told the gathering. Heavy metals, such as arsenic, are even more dangerous as they can lead to malignant tumors, she explained.<\/p><p><strong>Katarina Vaskovi\u0107<\/strong>, a participant of the protest rally, complained to the media in attendance that living in Bor was like being in a quarantine.<\/p><p>\u201cOur children live in a quarantine, we can take them outside only if we estimate that there isn\u2019t that much smoke. (\u2026) Every other child in the neighborhood has gotten an asthma inhaler,\u201d says Vaskovi\u0107.<\/p><p>The demonstrators supported the speakers for two hours straight.<\/p><p>However, on the day of the rally Bor was not polluted. The air did not cause scratching in the throat or made the eyes water, as the denizens of Bor usually claim, so there was no need to stay indoors. In some hours, the amount of SO2 in the air was 8.3 times higher than allowed, reads the inspector\u2019s report. SO2 is a pungent-smelling gas that leads to frequent coughing and irritation of the pharynx. It causes respiratory and cardiovascular diseases, and harms children, the elderly and people suffering from chronic pulmonary diseases the most.<\/p><p>Pollution was measured just a five minutes\u2019 walk away from the gates of the mining complex, at a station in the city park maintained by the <em>Serbian Environmental Protection Agency (SEPA).<\/em><\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><div class=\"antrefilecont\"><p><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>The smelter and sulfuric acid plant within the Smelter and Copper Refinery branch are among the weakest links of the complex. They are the most frequent sites toured by inspectors checking air pollution. Announced as a \u201cmiracle\u201d that will ensure both clean air and a higher profit, the new smelter was inaugurated in 2014. It melts ore to obtain copper, which is why SO2 is created. To get another product instead of pollution, processing turns SO2 into sulfuric acid. In that way, only slightly polluted air should be coming out of the chimneys. However, in reality that\u2019s not always the case.<\/span><\/p><\/div><\/div><\/div><p>The inspectorate checked <em>Zijin <\/em>in January 2020, too, and registered the same omissions, shows the documentation CINS had access to.\u00a0<\/p><p><a href=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/02\/Zi%C4%91in-tu%C5%BEila%C5%A1tvo.pdf\">A proceeding is under way<\/a>\u00a0before the <em>Commercial Court in Zaje\u010dar <\/em>against <em>Zijin <\/em>and the deputy manager of the Smelter and Copper Refinery branch which caused the problem, <strong>Boban Todorovi\u0107, <\/strong>for releasing hazardous substances into the air and for the company\u2019s failure to do anything to reduce pollution. They are accused of an economic offense that carries a fine of between 1.5 million and three million dinars, while the court may also hand down a sentence proportional to the damage done.<\/p><p><strong>Nata\u0161a \u0110ereg<\/strong>\u00a0of the <em>Center for Ecology and Sustainable Development <\/em>(CEKOR) NGO believes that such penalties do not help:<\/p><p>\u201cOur fines are ridiculous \u2013 of course it pays for all polluters to continue polluting, especially such large facilities, to pay the fine and carry on. A fine is not a measure, stopping production would be [the right] penalty.\u201d<\/p><p>Former manager of the Smelter and Copper Refinery branch, <strong>Paun Jankovi\u0107<\/strong>, says in an interview with CINS that halting production is not in the interest of the majority owner \u2013 currently Chinese state-owned <em>Zijin International Finance Company Limited<\/em>\u00a0(63%), while the <em>Serbian government <\/em>is the second biggest co-owner with 36.9%. Stopping operation means less revenue, but it can play a part in solving the problem, he explains:<\/p><p>\u201cThere are technical solutions \u2013 to urgently eliminate the causes of this bad emission. photo: CINS<\/em><\/h5><h2><strong>Zijin\u2019s Earlier Omissions<\/strong><\/h2><p>This is not the first time <em>Zijin, <\/em>previously RTB Bor, has not adhered to the rules. Since the privatization of the mining complex, in December 2018, inspector To\u0161i\u0107 detected various omissions at least five times.<\/p><p>Back in April 2019, the inspector ordered the company to take measures against air pollution that poses a threat to human life and health and to the environment, as it had released excessive amounts of SO2, show the reports CINS had access to. At the time, <em>Zijin <\/em>explained in a note to the <em>Ministry of Environmental Protection <\/em>that a power outage had caused the pollution.<\/p><p>However, another inspection conducted several months later, in August, revealed one more omission \u2013 <em>Zijin <\/em>did not have a system for wet dust removal during the transportation of tailings at the Bor mine, whereby it also jeopardized human health and the environment. <em>Zijin <\/em>was ordered to solve the problem, and the company later told the <em>Ministry <\/em>that a dust suppression system had been installed and that a test run was under way.<\/p><p>In November 2019, CINS requested an interview with <em>Zijin <\/em>on the subject of air pollution, to which the company replied with a press release. The release read that by the end of the year the company would have a total of five dust dispersion machines that neutralize SO2. The documentation CINS gained access to shows that up until that moment out of the two purchased machines one had already been in use for about two months, but the pollution data reveal that it had no significant impact on the reduction of sulfur dioxide \u2013 in October, the number of days with more SO2 in the air was only slightly smaller.<\/p><p><em>Zijin<\/em>\u00a0is announcing other investments, too \u2013 a dust and exhaust fumes collection facility, and by 2021 the construction of an additional facility that would enable \u201cthe emission of gases to always and completely be in line with the prescribed standards.\u201d<\/p><div class=\"rmbox\"><h2 class=\"rmboxtitle\">Zijin in Court for Inherited Problems as Well<\/h2><div class=\"rmboxteaser\"><p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>RTB has three failed privatizations behind it \u2013 twice the buyers did not pay the money, while the third call failed to attract any hopefuls. <b>Aleksandar Vu\u010di\u0107<\/b>, who was the prime minister at the time, initiated the solving of that problem in 2016 and asked Chinese Prime Minister <b>Li Keqiang<\/b> to help Serbia with the Bor complex.<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>The company was privatized in December 2018, while the press release <i>Zijin <\/i>sent CINS says that the environmental problems in Bor existed long before the acquisition.<\/span><\/p><\/div><div id=\"rmtease1789703\" class=\"rmboxtext hidden\"><p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>In 2018, inspectors on several occasions checked the pollution caused by the precious metals production facility \u2013 the electrolysis plant \u2013 at the heart of the RTB complex. <b>Blagoje Spaskovski, <\/b>a member of the <i>Serbian Progressive Party, <\/i>was at the helm of the former management at the time. The first report from March 2018 showed increased levels of lead and carcinogenic particles in the air, like arsenic, which can lead to lung cancer among other things.<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>The company was ordered to reduce pollution and measure it again. The next three checks, in August, September and December, did not show any improvement. RTB was sold, and inspectors came back for another inspection less than a month later \u2013 this time with a new owner of the company. As the situation had not changed, the <i>Ministry of Environmental Protection<\/i> pressed charges against <i>Zijin<\/i> and then General Manager <b>Long Yi <\/b>before the Basic Public Prosecutor\u2019s Office in Zaje\u010dar \u2013 just 40 days after the Chinese company bought the Bor-based giant. The trial is under way.<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>The face of the protests in Bor, Irena \u017divkovi\u0107, explains that there were the same problems in 2015 as there are today, but that after civil protests RTB reduced the volume of production, which, in her opinion, <i>Zijin <\/i>is not doing now.<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>The <i>Ministry of Environmental Protection <\/i>marked Bor as a black spot of Serbian ecology back in 2008.<\/span><\/p><\/div><div id=\"rmteaseb1789703\" class=\"rmboxteaserall\"><span>Show more<\/span><\/div>\n\n<script>\njQuery(document).ready(function(){\n    jQuery(\"#rmteaseb1789703\").click(function(){\n        if(jQuery(\"#rmtease1789703\").is(\":hidden\")){\n            jQuery(\"#rmtease1789703\").slideDown(400);\n            jQuery(\"#rmteaseb1789703 span\").text(\"Show less\");\n        } else {\n            jQuery(\"#rmtease1789703\").slideUp(400);\n            jQuery(\"#rmteaseb1789703 span\").text(\"Show more\");\n        }\n    });\n});\n<\/script>\n\n            <\/div><h2><strong>Shifting Responsibility<\/strong><\/h2><p>The citizens of Bor are not happy with their communication with the <em>Ministry, <\/em>because it does not give them answers as to the measures taken to reduce air pollution.<\/p><p>A recording of a telephone conversation between <strong>Sa\u0161a Stankovi\u0107, <\/strong>activist and chairman of the district chapter of the <em>Dveri <\/em>(Doors) movement, and <strong>Aleksandar Blagojevi\u0107, <\/strong>a <em>Ministry <\/em>inspection sector official<em>, <\/em>which the Bor activists in October 2019 posted on the Facebook page 1 Out of the 5 Million Bor, left the impression that inspectors do not even carry out on-site visits, but rather notify <em>Zijin <\/em>of pollution over the phone as part of regular procedure.<\/p><p>Blagojevi\u0107 explained that an inspector \u201ccalls the company up and points out that hourly values have been exceeded and that they need to reduce the volume of prod uction or put more fresh raw material than slag.\u201d He also underlined that the <em>City of Bor <\/em>was legally obliged to enact a Short-Term Action Plan that would determine when <em>Zijin <\/em>should halt production for a few hours or days.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><div class=\"antreimg\"><img decoding=\"async\" src=\"https:\/\/www.cins.rs\/wp-content\/uploads\/2020\/02\/Ljiljana-Leki\u0107-from-the-City-of-Bor-environmental-protection-office-photo-CINS-2.jpg\"  \/>\n            <figcaption class=\"wp-caption-text\"> <\/figcaption>\n            <\/div><div class=\"antrefilecont\"><p>Ljiljana Leki\u0107 from the City of Bor environmental protection office; photo: CINS<\/p><\/div><\/div><\/div><p><em>City <\/em>officials told CINS that the Short-Term Action Plan had nothing to do with the work of the state inspectorate.<\/p><p>\u201cIt\u2019s well known how inspectors work. (\u2026) When any kind of accident happens, an inspector conducts an on-site visit to see what is going on, puts together minutes, measures are taken unrelated to the Short-Term Action Plan. We will see when we have enacted the Plan, how much we will be able to affect the company\u2019s operation,\u201d Ljiljana Leki\u0107 from the <em>City of Bor <\/em>environmental protection office told CINS.<\/p><p>She explained that they had already begun making the Plan and that the process involved representatives of local environmental associations, including those that were organizing the protests. Nonetheless, Leki\u0107 says the plan will only provide guidelines for solving the problem.<\/p><p><strong>Toplica Marijanovi\u0107<\/strong>, once a deputy director for environmental protection at RTB, says that the action plan is not binding, and so not even an inspector can ask the polluter to implement it.<\/p><p>\u201cThat is an effort of the Ministry, i.e. the government to shift all the responsibility for the state of air quality to the local self-government unit, while the local self-government unit has neither the jurisdiction nor the capacity to react in any way in the industrial and mining facilities to which the authorities issue operating permits,\u201d says Marijanovi\u0107.<\/p><p>Meanwhile, the citizens of Bor are still appealing for a solution to the pollution problem. SEPA has issued a warning that January 24 and 26 were hazardous to human health due to high SO2 levels at two measuring sites.<\/p><p>While <strong>Aleksandar Miliki\u0107<\/strong>, the mayor of Bor and an official of the Serbian Progressive Party, is saying that the pressure is political because the protests are led by <em>Alliance for Serbia <\/em>member and an associate of <strong>Dragan \u0110ilas, Irena \u017divkovi\u0107, <\/strong>she and three other activists, including Sa\u0161a Stankovi\u0107 from <em>Dveri, <\/em>in late November pressed charges against <em>Zijin Bor Copper <\/em>CEO <strong>Long Yi, <\/strong>the Bor mayor, and Environmental Protection Minister <strong>Goran Trivan, <\/strong>for air pollution.<\/p><p>The <em>Ministry <\/em>did not answer CINS\u2019 questions about control of the local self-government unit regarding the enactment of the Short-Term Action Plan, nor whether it will be able to order <em>Zijin <\/em>to stop production.<\/p><h2><strong>New Owner \u2013 New Pollution<\/strong><\/h2><p>According to regulations, SO2 can be exceeded at a single measuring site for just three days in a year. That rule has not been abided by for years. The measuring station in the city park, not far from the mining complex, in 2014 detected unpermitted SO2 pollution for five months on average, while by 2018 the number of days dropped to 13, and then with the Chinese investor jumped to 40, according to SEPA data.<\/p><div class=\"fullws\"><iframe src='https:\/\/e.infogram.com\/769fa20b-e26b-45ef-b506-38f551ce2e10?src=embed' title='SULFUR DIOXIDE (SO2) IN BOR BY YEAR (2014\u20132019)' width='1200' height='700' scrolling='no' frameborder='0' style='border:none;' allowfullscreen='allowfullscreen'><\/iframe><\/div><p>The findings of the <em>Mining and Metallurgy Institute Bor <\/em>for 2018 are not encouraging. Year-over-year, there were higher than allowed levels of SO2 and harmful PM10 particles, which most often cause vascular and respiratory diseases. There was 24 times more arsenic than allowed in Bor. Pollution in many places in Serbia is above legally permitted levels, <a href=\"https:\/\/www.cins.rs\/vazduh-u-srbiji-opasan-godinama\/\">which CINS reported on earlier<\/a>.<\/p><p>The high levels of pollutants affect the health of Bor citizens.<\/p><p>Roughly two thirds of preschoolers and a half of children under the age of 18, who sought medical assistance in the period between 2014 and 2018, had respiratory problems. They most frequently suffered from pharyngitis and tonsillitis, according to the data on the state of health of Bor\u2019s citizens, published by the <em>Timok Public Health Institute <\/em>in Zaje\u010dar.<\/p><p>These two types of inflammation are the second most frequent disease in adults, with nine cases per 100 citizens.<\/p><p>Although dominant, these diseases saw a slight downward trend in the observed five-year period, in parallel with the decline in production at the complex and lower air pollution.<\/p><p>After RTB Bor was privatized, pollution went up again.<\/p><div class=\"rmbox\"><h2 class=\"rmboxtitle\">Former Manager at RTB: RTB Engineers Were Not Taught to Follow Regulations<\/h2><div class=\"rmboxteaser\"><p class='MsoNormal'><b><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>Paun Jankovi\u0107<\/span><\/b><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>, a former head of the Smelter and Cooper Refinery branch at the Bor complex, is retired today but clearly remembers that there have always been problems with pollution. When the legal limit is exceeded, inspectors show up, production is reduced and so on, Jankovi\u0107 explains in an interview with the CINS journalist.<\/span><\/p><\/div><div id=\"rmtease6870575\" class=\"rmboxtext hidden\"><p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>Violation of regulations has been nurtured for decades with the excuse, \u201cyou want us to shut down the mine and then have nothing to live off,\u201d says Jankovi\u0107 and adds:<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>\u201cThe engineers were not taught to follow regulations, but rather to find a way to overcome the problem according to the motto \u2018carry on\u2019.\u201d<\/span><\/p>\r\n<p class='MsoNormal'><span style='font-size: 12.0pt; line-height: 115%; font-family: 'Times New Roman',serif;'>Paun Jankovi\u0107 lives in Bor, he went to school there and spent his entire career at RTB as an engineer on various jobs. During the interview, he coughed every few minutes.
