{"id":26635,"date":"2020-05-25T12:09:31","date_gmt":"2020-05-25T10:09:31","guid":{"rendered":"https:\/\/www.cins.rs\/?p=26635"},"modified":"2020-10-29T16:59:12","modified_gmt":"2020-10-29T14:59:12","slug":"serbian-mp-gets-montenegrin-company-as-gift-fails-to-report-it-to-anti-corruption-agency","status":"publish","type":"post","link":"https:\/\/www.cins.rs\/en\/serbian-mp-gets-montenegrin-company-as-gift-fails-to-report-it-to-anti-corruption-agency\/","title":{"rendered":"Serbian MP Gets Montenegrin Company as Gift, Fails to Report It to Anti-Corruption Agency"},"content":{"rendered":"<p>The formal head office of the <em>Habit Invest <\/em>company is located in a two-story building in a downtown of a Montenegrin capital Podgorica, at 45 Njego\u0161eva Street. Although there is no visible business sign of <em>Habit Invest <\/em>in the building, the company has existed since 2000 and since September 2002 its owner and representative has been <strong>Milutin Mrkonji\u0107<\/strong>, a senior official of the <em>Socialist Party of Serbia<\/em>, former minister of infrastructure and energy and subsequently minister of transportation.<\/p><p>A little more than four years after taking over the company, Mrkonji\u0107 was also elected as MP and deputy speaker of the <em>National Assembly of Serbia<\/em>, and with that office came the duty of transferring managing rights in the company to another person not connected with him \u2013 such as a family member or partner \u2013 within 30 days. He was bound to do so by the Law on Prevention of Conflict of Interest in Discharge of Public Office, and as of 2008 by the Law on the Anti-Corruption Agency. However, Mrkonji\u0107 has not done that to date.<\/p><p><strong>Nemanja Nenadi\u0107 <\/strong>from <em>Transparency Serbia<\/em> says that Mrkonji\u0107 could have authorized someone else to run the company in his name and for him, but should not have continued to manage the company:<\/p><p>\u201cHe should not be the representative. He should not be involved in the work (of the company) in any way,\u201d says Nenadi\u0107.<\/p><p>Representatives of the <em>Anti-Corruption Agency <\/em>point out another potential violation of the Law on the Agency \u2013 even though he has submitted 12 reports on his property and income so far, Mrkonji\u0107 has not listed ownership of this company.<\/p><p>\u201cAn examination of the aforementioned reports has revealed that Milutin Mrkonji\u0107 did not report his ownership stake in a legal entity, and thereby in <em>Habit Invest d.o.o. Podgorica, <\/em>in any of the reports,\u201d Agency officials told CINS.<\/p><p>For that reason, they added, they will check whether there are grounds for launching proceedings against Mrkonji\u0107. What happened in Montenegro?\u201d<\/p><p>When the CINS journalist mentioned the company Mrkonji\u0107 had there, he asked that they talk later. However, he later said he did not know what the journalist was talking about and that he did not wish to discuss it over the phone. He promised to provide an additional explanation at a meeting. Nonetheless, Mrkonji\u0107 did not answer his phone at the agreed time and when he finally did, he asked that they postpone the conversation until after the elections, and then also remarked: \u201cYou have no comment. Who are you for me to give you comments? What\u2019s wrong with you? Pull yourself together, man.\u201d<\/p><p>According to data found in the Montenegrin <em>Central Registry of Business Entities, <\/em>the company has another representative \u2013 <strong>Ljiljana Svrzi\u0107 <\/strong>from Belgrade, who has been performing the office of acting director in <em>Habit Invest <\/em>since 2004. Svrzi\u0107 declined to comment on the company\u2019s operations and cooperation with Mrkonji\u0107, asking: \u201cWhat good would all that do me?\u201d<\/p><h2><strong>The Liechtenstein Connection<\/strong><\/h2><p>In August 2012, the media reported that <strong>Radosav Lale Sekuli\u0107 <\/strong>had been arrested, among others. Sekuli\u0107 is a former director of the <em>Federal Customs Administration, <\/em>former head of the municipality of Ivanjica, one of the founders and former co-owner of bankrupt joint stock company <em>Habit Pharm, <\/em>who, according to media reports, was close to the Socialist Party of Serbia.<\/p><p>He was arrested over the corruption affair related to <em>Agrobanka, <\/em>from which he had until 2011 taken unsecured loans for his companies, which he never paid back. At the time, Mrkonji\u0107 claimed to have no business relationship with the participants in the embezzlement, but that Sekuli\u0107 was \u201ca friend, like <strong>Slobodan Milo\u0161evi\u0107 <\/strong>had been.\u201d<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">Agrobanka affair: embezzlement of 84 million euros<\/h2><div class=\"antrefilecont\"><p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>On suspicion that <i>Agrobanka <\/i>failed because it had issued unsecured loans in the period between 2005 and 2011, in August 2012 police arrested the bank\u2019s CEO, <b>Du\u0161an Antoni\u0107<\/b>.<b> <\/b><\/span><\/p>\r\n<p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>By the end of the month, the number of individuals suspected of embezzling 84 million euros had grown to several dozen. Among them were <b>Radosav Lale Sekuli\u0107 <\/b>and his son <b>Du\u0161ko Sekuli\u0107<\/b>,<b> <\/b>who were suspected of having taken these loans for <i>Habit Pharm <\/i>and its affiliates. <\/span><\/p>\r\n<p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>A trial is under way before the Higher Court in Belgrade. Radosav Sekuli\u0107 did not see the end of the investigation, as he passed away in 2014.<\/span><\/p><\/div><\/div><\/div>However, the connection between Mrkonji\u0107 and the (now deceased) Sekuli\u0107 was much more than friendship, CINS has learned.<\/p><p>Sekuli\u0107 founded drug manufacturer <em>Habit Pharm <\/em>in Ivanjica in 1997, together with his son <strong>Du\u0161ko <\/strong>and the company <em>Habit Med <\/em>from Liechtenstein, a state known as an offshore haven.<\/p><p>Mrkonji\u0107 took over the Montenegrin <em>Habit Invest <\/em>from <em>Habit Med <\/em>and <strong>Zoran Vidi\u0107 <\/strong>free of charge in September 2002, reads the ownership transfer agreement.<\/p><p>The former owners, according to the same agreement, waived all rights and obligations, including ongoing deals, but also the 10.000 dollars of initial capital invested.<\/p><p><strong>Vlado Ostoji\u0107 <\/strong>from Belgrade remained the executive director until September 2004, when he was replaced by Ljiljana Svrzi\u0107.<\/p><p>After taking over the company, Mrkonji\u0107 replaced the main operation of selling medicines and medical equipment with something more familiar to him \u2013 specialist construction works.<\/p><p>According to the information CINS received from the <em>Agency for Construction and Development of Podgorica, Habit Invest <\/em>cooperated with this public institution from 2002 and 2004, on the making of a detailed zoning plan of Nova Varo\u0161 2, Gorica C and on the project of a bridge on Ratnih Veterana Street.<\/p><p>Mrkonji\u0107\u2019s company earned 41,500 euros through those projects.<\/p><p>The company has not had any registered turnover for years and has been blocked since June 2005. On the last day of 2019, <em>Habit Invest\u2019s<\/em> account was frozen due to a debt of just under 6.000 euros.<\/p><h2><strong>Office Space in Belgrade Link to Sekuli\u0107<\/strong><\/h2><p>With Podgorica-based <em>Habit Invest, <\/em>Milutin Mrkonji\u0107 also moved into the company\u2019s office in Belgrade in 2002. Several offices, a storeroom, a spacious room with a bar, toilet and storeroom \u2013 all that spanning 212 square meters located in Belgrade\u2019s high-end Dedinje quarter, became Mrkonji\u0107\u2019s office space.<\/p><p>According to the company\u2019s Articles of Association, all mail was delivered to the address of the Belgrade office \u2013 27 Teodora Drajzera Street.<\/p><p>Radosav Sekuli\u0107\u2019s <em>Habit Pharm <\/em>became the owner of this space in April 2003, and so the pharmaceutical company\u2019s headquarters also moved to this address.<\/p><p>Later on, AIK Banka took over the office space in Dedinje on account of unpaid debts.<\/p><p>When he took over the company from its previous owner, Mrkonji\u0107 also kept the director of <em>Habit Invest\u2019s <\/em>Belgrade office \u2013 <strong>Aleksandar Jankulovi\u0107<\/strong>. Jankulovi\u0107 previously, from 1995 to 2001, worked at the <em>Institute of Transportation CIP. <\/em>At that time, the director of this analysis and design institution was none other than Mrkonji\u0107.<\/p><div class=\"antrefile-container\"><div class=\"antrefile\"><h2 class=\"antretitle\">Hidden ownership of Habit Med<\/h2><div class=\"antrefilecont\"><p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>Even though it is landlocked, because of its tax benefits Liechtenstein is considered an offshore haven, suitable for hiding ownership of a company. After <b>Radosav Sekuli\u0107<\/b> was arrested in 2012, Serbian and Montenegrin media reported that Sekuli\u0107 was the man behind Liechtenstein-based <i>Habit Med. <\/i><\/span><\/p>\r\n<p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>However, according to official data, the owner of this company was one <b>Ulrike Antonia Schreiber-Eggenberger<\/b>. <\/span><\/p>\r\n<p><span lang='EN-US' style='font-size: 12.0pt; line-height: 107%; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;'>The data from Liechtenstein\u2019s central register mark her as the owner of several companies, which are, like <i>Habit Med, <\/i>registered in the town of Schaan. <i>Habit Med <\/i>was shut down in February 2012.<\/span><\/p><\/div><\/div><\/div>Jankulovi\u0107 refused to speak to CINS about cooperation with this official.<\/p><p>\u201cWithout going into the intentions of your story, I think there is nothing interesting about the company <em>Habit Invest. <\/em>I have long lost touch with all the people you mentioned,\u201d Jankulovi\u0107 briefly said.<\/p><p>After the company was shut down in March 2005, a new company moved into the office space in Dedinje \u2013 <em>Habit Sport, <\/em>owned by Du\u0161ko Sekuli\u0107, followed by a company called <em>Diabact<\/em>, which Du\u0161ko Sekuli\u0107 is the director of today.<\/p><p>Du\u0161ko Sekuli\u0107, who is standing trial for the <em>Agrobanka <\/em>affair, denies cooperating with Mrkonji\u0107 and says that he only saw him a few times.<\/p><p>\u201cI don\u2019t actually know him. The man is 80, I\u2019m 50. I met the man five times and that\u2019s all,\u201d Du\u0161ko Sekuli\u0107 told CINS.<\/p><p>He claims to have nothing to do with <em>Habit Invest <\/em>either, even though the previous office of the company, in 2001, was located at 10 Uzun Mirkova Street, in office space rented from none other than Du\u0161ko Sekuli\u0107.<\/p>","protected":false},"excerpt":{"rendered":"<p>A member of parliament, former minister and senior official of the Socialist Party of Serbia, Milutin Mrkonji\u0107, in 2002 took over \u2013 completely free of charge \u2013 ownership of Montenegrin company Habit Invest, which had been linked to Radosav Sekuli\u0107, otherwise known as an actor in the Agrobanka affair and a man close to the Socialist Party of Serbia.
